Johnson & Johnson Breeching Doctor-Patient Confidentiality In Pursuit Of Patient Release Forms
Upon initiating the DePuy hip recall for the ASR XL Acetabular Hip System and the ASR Hip Resurfacing System, the company released a guide for both patients and surgeons. For patients that have received defective devices, DePuy attempts to reassure these patients of the company’s intention to do the right thing and aid those who were affected. The company promises to offer coverage of what they deem “reasonable” treatment and testing costs, and highly encourages patients to contact the company directly using a toll-free number.
For the surgeons, additional information was placed in their guide which raised concerns and questions regarding Johnson & Johnson and its commitment to giving aid to those patients requiring regular monitoring and testing and who may potentially have to undergo painful and risky corrective surgery. The guide contains a consent form for the doctors to give to patients receiving any recalled hip replacement devices. Once signed, the patient is in agreement with the following stipulations:
· DePuy will have access to all medical records and x-rays from an initial or corrective hip replacement surgery, including everything from doctor’s orders to records related to follow-up visits.
· Any defective device removed from a necessary corrective surgery may be returned to DePuy.
· DePuy may use all the information gathered indirectly through the surgeons for analytical purposes.
Even more alarming, surgeons are being offered payments in exchange for having their patients complete releases and then submitting them to DePuy. Two major concerns are raised. First, Johnson & Johnson obviously has less than honorable plans for this valuable patient information. It is believed that DePuy plans on making the case that they could not be held liable for damages due to device failure if medical records show that the patient did not follow doctor’s orders exactly. Having the implants returned to the company after corrective surgery takes away key evidence in future hip replacement lawsuits. Secondly, the paying off of doctors for patient release forms should be in clear violation of doctor-patient confidentiality. This not only damages the relationship between the patient and his or her physician, but can also jeopardize the future healthcare of the patient.
These concerns clearly lead to the fact that DePuy has no intention of protecting patients affected by the hip replacement recall. Under no circumstances should any information be released to a third party, like DePuy, even under the advice of a trusted family physician or surgeon. Victims affected by the hip replacement recall need to contact a hip replacement lawyer in order to protect their rights and get the punitive damages they deserve.
